What Does a Conveyancer Do?

Conveyancing is the legal process transferring a property from one person to another.

A Conveyancer’s role is to accurately prepare the Contract for Sale of Land for a seller and ensure that all relevant documents are annexed to the Contract and to go through a Contract for a Purchaser and alert them to any potential risks.

A Conveyancer on a sale will prepare a Contract for Sale of Land for a seller and obtain in depth instructions regarding inclusions, if there is anything they have done which could potentially be a problem for a Purchaser that may not come up in a normal inspection. When a Purchaser is found, we will go through the Contract with the Seller and ensure the contract accurately reflects the true status of the property.

For a purchase, a Conveyancer will go through the sale Contract in depth and advise Purchasers on any risks, inclusions noted, liaise with their Mortgagee to ensure their loan paperwork is correct and prepare necessary documents to enable the property to be transferred into their names on settlement. This is where a Pest & Building or Strata report will be ordered so the Purchasers can read through these documents prior to be locked in to the purchase unconditionally.

Exchange Process

When the Buyer and Seller are both ready to be locked in to the Contract (subject to any cooling-off period), both Contracts are checked to make sure they are identical by the Seller’s Conveyancer and then dated. This means that the Contracts are exchanged. Once the cooling-off period expires, the matter can then start to be prepared for settlement by our Settlement Team, under the supervision of our Conveyancers.

Settlement Process

For both a purchase and sale, settlement will take place on PEXA, an electronic platform which all Conveyancers, Solicitors and Mortgagees will link in and join the electronic settlement workspace. Settlement usually takes around half an hour on PEXA and when we give you that call, you can go and pick up the keys or expect your settlement process in your Bank account.
